1. Campaign Period
This Kakitangan.com Member-Get-Member (MGM) Campaign (“Campaign”) organized by Coastal Hectare Sdn Bhd (Company number 1112266-U) (“Kakitangan”) will commence on 3 April 2023 to 30 September 2023 (both dates inclusive) (“Campaign Period”).
2. Eligibility
a. Subject to these terms and conditions, in particular, Clause 8 hereof, this Campaign is open to any existing Kakitangan’s customers who has attained the age of 21 years old and possess a valid and active account at https://app.kakitangan.com/login at the time of introducing contacts or another person to sign up with Kakitangan (“Eligible person”);
b. For the avoidance of doubt, any person who possess a valid account at https://app.kakitangan.com/login can become Eligible Person, regardless of the role in their company, i.e., the admin user or the employee user of Kakitangan account can participate in this program;
c. The following categories of person(s) are NOT eligible to participate in the Campaign:
i) Permanent and/or contract employees of Kakitangan (including its subsidiaries and related companies), including their respective immediate family members (i.e., parents, spouses, children and siblings);
ii) Affiliates or partners of Kakitangan who has active collaboration and/or referral relationship with Kakitangan;
iii) Any person who is not an active Kakitangan customers and/or do not possess valid login credentials at https://app.kakitangan.com/login
3. Submission of Referral
Eligible Person may introduce contacts or another person to sign up with Kakitangan and this contact or another person shall be referred to as “Prospects” or each, a “Prospect”.
4. Rewards Qualifier
An Eligible Person will become Qualifier when his Prospect completed the purchase as stated in Clause 8 below.
5. Prospect can become Eligible Person
A Prospect who becomes Kakitangan’s customer and fulfills the eligibility (as mentioned in Clause 2 above), then subsequently introduces contacts or another person to Kakitangan, will also be considered as Eligible Person.
6. Campaign Mechanics and Criteria for Eligible Person
a. Eligible Person shall visit kakitangan.my/mgm-202304 (“Campaign Website”) and introduce prospect(s) by submitting the form at the Campaign Website;
b. Eligible Person shall provide their valid email address (recognize at https://app.kakitangan.com/login) at the form to ensure the Prospect is tagged to the Eligible Person;
c. Eligible Person can introduce any Prospect who currently does not have any account with Kakitangan, or the Prospect’s account has been closed/cancelled for more than 6 months;
d. If a Prospect introduced by Eligible Person already has a record with Kakitangan (for any record(s) created with Kakitangan on or after 1 October 2022), the submission is deemed to be invalid (“Invalid Submission”).
IMPORTANT NOTE:
It is the Eligible Person’s responsibility to ensure that their information (such as name, email address, company name) submitted at the form are match with Kakitangan’s record. Failure to do so may result in referral being invalid.
7. Campaign Mechanics and Criteria for Prospect
a. Prospect must complete the purchase (as stated in Clause 8 below) with Kakitangan between 1 April – 30 September 2023 by making full payment of subscription fee to Kakitangan;
b. A Prospect must not have any existing record with Kakitangan at the time of submission except in the case of the following:
i) An existing record created on 30 September 2022 or earlier, but the proposal was rejected or cancelled by Prospect;
ii) An existing record created on 30 September 2022 or earlier but no closure or pending status.
IMPORTANT NOTE:
All introduction of Prospects must be submitted through Campaign Website. In the event of one single Prospect referred to Kakitangan is more than one Eligible Persons, then only 1 Eligible Person (the earliest record registered with Kakitangan) will be rewarded. It is the Eligible Person and Prospect’s responsibility to ensure that their information (such as name, email address, company name) submitted at the form are match with Kakitangan’s record. Failure to do so may result in referral being invalid and no rewards will be given.
8. Requirements to qualify for Completion of Purchase
a. For the avoidance of doubt, the completion of purchase of any product or services by Kakitangan means a Prospect has made full payment to Kakitangan, whether by the way of credit card, online transfer, or cash bank in to Kakitangan’s bank account, based on the amount stated in the invoice.
b. The minimum requirements to qualify for completion of purchase would be purchase of at least 3 modules (Payroll, Leave and Claim modules) and not less than 10 employees, and for minimum of 2 years’ subscription.
9. Campaign Mechanics
To qualify for the Rewards (as defined below), Eligible Person shall refer the Prospect during the Campaign Period and Prospect must complete the purchase as defined in Clause 8 above. The Rewards are specified in the following table:

Cash Reward, and Gift Reward shall be collectively known as “Rewards”.
*If there are 2 successful completions of purchase, the Eligible Person will be 2x RM100 cash reward. If there are 5 successful completion of purchase or more, the Eligible Person will 5 x RM100 cash reward plus 1x Gift Reward.
10. Additional Terms & Conditions for Cash Reward
a. The Cash Reward will be paid via bank transfer within 12 weeks after 30 September 2023. The Qualifier should ensure his/her email and/or phone number is contactable for the information required for bank transfer processing;
b. A Whatsapp message will be sent to the Qualifier phone number that they will be rewarded with the Cash Reward;
c. At the time of Cash Reward payout, the Qualifier’s account(s) with Kakitangan should be in active status (i.e., not cancelled, pending or inactive);
d. In the event of the Qualifier’s account is not active at the time of Cash Reward payout, they will have a grace period to reactivate the account by 30 October 2023 in order to qualify for the Cash Reward. Kakitangan reserves the right to revoke the Rewards if the Qualifier’s account is not activated after 30 October 2023;
e. Cash Reward is not transferable, nor exchangeable for credit or kind whether in part of in full.
11. Additional Terms & Conditions for Gift Reward
a. Any Qualifier who fulfils the Tier 2 Rewards criteria will receive one (1) Gift Reward;
b. The Gift Reward will be supplied by Kakitangan’s participating partner (“Partner”) and will be delivered to the Qualifier registered mailing address with Kakitangan’s system and records within 2 months from 30 September 2023;
c. For any request of change of delivery address, the Qualifier may write in the request to marketing@kakitangan.com by 30 October 2023 and supply the following information:
i) Qualifier’s name;
ii) Qualifier’s email address (must be a valid email address recognize at https://app.kakitangan.com/login);
iii) Qualifier’s contact number
iv) Qualifier’s current address in Kakitangan’s system and records;
v) Qualifier’s desired delivery address.
d. A Whatsapp message will be sent to the Qualifier phone number that they will be rewarded with the Cash Reward;
e. At the time of Gift Reward fulfillment, the Qualifier’s account(s) with Kakitangan should be in active status (i.e., not cancelled, pending or inactive);
f. In the event of the Qualifier’s account is not active at the time of Gift Reward fulfillment, they will have a grace period to reactivate the account by 30 October 2023 in order to qualify for the Cash Reward. Kakitangan reserves the right to revoke the Rewards if the Qualifier’s account is not activated after 30 October 2023.
g. Gift Reward is not transferable, nor exchangeable for cash or credit or kind whether in part or full;
h. Gift Reward is given out on “as is” basis;
i. Gift Reward is subject to availability from the supplier. In the event that the supplier is unable to supply the same model of the Gift Reward, Kakitangan reserves the right, as it deems fit to substitute with Gift Reward with another product of similar retail value;
j. Gift Reward does not include any accessories or items that are shown in any advertisements or promotional materials as they are for illustrative purposes only;
k. The delivery of Gift Reward will be fulfilled by Partner;
l. To the fullest extent permitted by law, there are no, and Kakitangan expressly excludes and disclaims any, representations, warranties, or endorsements, expressed or implied, written or oral, including but not limited to, any warranty of quality, merchantability or suitability or fitness for a particular purpose in respect of the Gift Reward. All disputed, claims or warranties must be addressed with the supplier or the manufacturer. Where applicable, Qualifier will be solely responsible to bear any taxes, charges or fees
attributable to such purchases;
m. The title in the Gift Reward and any risk of loss or damage to the Gift Reward will pass to the Qualifier upon delivery of the Gift Reward to such Qualifier. Kakitangan shall not be liable for or obliged to recognize or replace any defective, lost, damaged or stolen Gift Reward where such defect, loss or damage in respect of the Gift Reward is not due to the fault and/or negligence of Kakitangan; and
n. If there is any dispute or non-receipt of the Gift Reward, Qualifier are required to contact Kakitangan at marketing@kakitangan.com by 5 January 2024 at the latest to request an inquiry. No request for any inquiry will be entertained after 5 January 2024.
12. Other Terms and Conditions
a. Kakitangan reserves the right to forfeit the Rewards under this Campaign if the Qualifier is found to be a person who:
i) is not eligible to participate in the Campaign and/or receive the Reward; and/or;
ii) has committed or is suspected of committing any misconduct, fraudulent or wrongful acts in relation to his/her use of Kakitangan’s service or facilities.
b. Kakitangan’s decision on all matters relating to the Campaign will be final and binding.
c. To the fullest extent permitted by law, by participating in this Campaign, each participant is agreeing that he/she will not hold Kakitangan and its directors, officers, servants, employees, representatives and/or agents, liable for any loss or damages that he/she may incur, in connection with the Campaign. Any liability that Kakitangan may have to any Eligible Person/ participant/ Referrer/Qualifier or any other person (if any) is limited to Direct Damages only, “Direct Damages” means actual damages or losses suffered by the Eligible Person/participant/Referrer/Qualifier or any other party (if any) as a result of a direct and immediate action by Kakitangan and shall not include any compensation for special, punitive, indirect, incidental or consequential damages or losses of any kind whatsoever, including but not limited to loss of profits, business or value, whether or not foreseeable.
d. Kakitangan will not be liable for any default due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm, epidemic, pandemic, technical or system failure or any event beyond the reasonable control of Kakitangan.
e. Eligible Persons, and/or Participants who participate in this Campaign are deemed to have expressly agreed to be bound by these Terms and Conditions (as varied or changed), the decisions of Kakitangan and/or the judges and, to the fullest extent permitted by law, to have consented to and authorized Kakitangan to disclose their particulars to the third party service providers, appointed agency and participating merchants engaged by Kakitangan for purposes of the Campaign. Kakitangan warrants that the disclosure of such particulars to any third-party service providers shall be limited to the Eligible Persons’ or Eligible Persons’ or Participant’s names, addresses, telephone numbers and last 6 digits of NRIC / Passport numbers and shall be used only in relation to and for purposes of the Campaign including fulfilment. Kakitangan’s decision on all matters relating to the Campaign (including the interpretation of these Terms and Conditions) shall be final and binding and no further correspondence or attempt to dispute such decision would be entertained.
f. Kakitangan reserves the right as it deems fit to vary or change any of these terms and conditions from time to time or cancel, terminate, withdraw, or suspend this Campaign and/or replace this Campaign with another similar promotion, campaign, or program with prior notice. Such variation, changes, cancellation, termination, withdrawal or suspension will be notified by posting on the Campaign Website or on kakitangan.com or in any other manner as Kakitangan deems fit. In this respect, the participants participation in this Campaign also signifies his/her agreement to access the Website at regular intervals to view these terms and conditions and to ensure that they are kept up to date with any variations or changes which Kakitangan may effect from time to time. Participants also agree that their continued participation in this Campaign will constitute their acceptance of these terms and conditions (as varied from time to time). For the avoidance of doubt, any cancellation, termination, withdrawal, or suspension by Kakitangan of this Campaign will not entitle the participant to any compensation against Kakitangan for any and all loss or damage that may be suffered or incurred by the participant as a direct or indirect result of the act of cancellation, termination, withdrawal or suspension.
g. Any terms and conditions applicable to this Campaign which is illegal, prohibited, or unenforceable under any law or regulation shall be ineffective to the extent of such illegality, voidness, prohibition, or unenforceability without invalidating the remaining provisions.
h. These Terms and Conditions are governed by and construed under the laws of Malaysia.
